Kerala Story 2 Case Judge Dharmadhikari Set for Chief Justice Elevation

What Has Recently Happened

The Supreme Court Collegium has recommended the elevation of Justice Sushrut Arvind Dharmadhikari, presently serving at the Kerala High Court, as the next Chief Justice of the Madras High Court. He is known for hearing the case regarding the film The Kerala Story 2.

The Collegium has also proposed that Justice Lisa Gill be transferred and appointed as Chief Justice of the Andhra Pradesh High Court.

These recommendations are not final yet and are currently pending approval from the Union Government of India.

Only after executive clearance and Presidential notification do such judicial appointments officially take effect.

Constitutional Scheme of Judicial Appointments

Constitutional Provisions

Article 124 → Appointment of Supreme Court judges

Article 217 → Appointment of High Court judges

Article 222 → Transfer of High Court judges

Article 74 → President acts on aid and advice of Council of Ministers

Article 50 → Separation of judiciary from executive (Directive Principle)

Doctrine of Collegium Governance

The Constitution does not explicitly mention the Collegium. It evolved through Supreme Court judgments:

First Judges Case (1981) → Executive had primacy.

Second Judges Case (1993) → Judicial primacy established.

Third Judges Case (1998 Presidential Reference) → Collegium structure clarified.

Current Composition

Chief Justice of India

Four senior-most Supreme Court judges

They collectively recommend appointments and transfers.

Constitutional Basis of Judicial Transfers

Governed by Article 222.

Transfers may be made:

For administrative efficiency

To promote national integration of judiciary

To prevent local bias or influence

Consent of judge is not constitutionally required, but consultation with CJI is mandatory.

Legal Analysis and Interpretation

This development reflects the continuing constitutional balance between:

Judicial independence (Collegium recommendations)

Executive oversight (final approval authority)

The system aims to prevent concentration of appointment power in any single organ of the State.
